New Rules Announced for Disability Benefits Recipients Moving to Scotland
Individuals receiving Personal Independence Payment (PIP), Disability Living Allowance for Children (DLAc), and Carer’s Allowance who relocate permanently to Scotland must now submit a new claim for equivalent benefits. The Department for Work and Pensions (DWP) has confirmed this change in regulations, which affects those currently residing in England or Wales.
Previously, claimants’ cases were automatically transferred to Social Security Scotland, which provided the corresponding devolved benefits without needing a new application. This automatic transfer process concluded on November 6, and moving forward, anyone transitioning from England or Wales to Scotland must initiate a new claim for benefits such as Adult Disability Payment, Child Disability Payment, and Carer Support Payment.
Guidance for Smooth Transitions
From Spring 2024, individuals receiving Attendance Allowance who move to Scotland will also have to apply for the Pension Age Disability Payment. To minimize disruptions in financial support, the DWP urges individuals to make these applications promptly after their move. It is essential for claimants to inform the DWP or the Department of Communities in Northern Ireland about their relocation prior to applying to Social Security Scotland.
Older individuals on DLA will also need to notify their current benefit provider and contact Social Security Scotland to request the Scottish Adult DLA. Karyn Dunning, deputy director at Social Security Scotland, emphasized the importance of taking these steps to ensure continued access to financial support.
“It’s vital disabled people and carers who move to Scotland take action to ensure they continue to get the financial support they are entitled to,” Dunning stated. “We know applying for benefits can feel daunting, especially alongside moving to a new country, but there is an in-depth guide available on mygov.scot.”
Support and Resources Available
Dunning highlighted that assistance is readily available for those navigating these changes. Social Security Scotland offers support over the phone, via webchat, or through in-person appointments with community-based advisors. She encouraged individuals not to delay their applications, noting that the Scottish benefits system operates under distinct principles focused on dignity, fairness, and respect, differing significantly from the DWP’s approach.
It is also important for claimants to note that the DWP will continue to provide payments for PIP, DLA for children, and Carer’s Allowance for an additional 13 weeks after moving to Scotland. This extension aims to provide a buffer during the claims processing period, reducing the risk of financial disruption.
Successful applicants for devolved disability benefits may be eligible for backdated payments, starting from the day after their DWP benefits ceased.
