Court Releases Foreign Nationals Detained Over Attempted Murder Charges
The High Court of Podgorica has lifted the detention of two foreign nationals, Turkish citizen Y.G. and Azerbaijani citizen N.D., who were previously charged with attempted murder against local resident M.J.. The court’s decision came after a thorough review revealed that the defendants were in their accommodation at the time of the alleged crime.
According to a statement from the High Court, the investigation judge determined that there was insufficient evidence to support the charges against Y.G. and N.D.. The Higher State Prosecutor’s Office in Podgorica submitted a request for the revocation of detention, citing that the accused had consistently denied involvement in the crime. Their defense was corroborated by surveillance footage from cameras installed at their residence, which was reviewed after the initial detention order was issued on October 29, 2025.
The court noted that the video analysis confirmed the defendants’ alibi, indicating they were not present at the scene during the incident involving M.J.. As a result, the judge ruled that the basis for detention no longer existed, leading to the release of both individuals.
The prosecution had initially argued for detention based on suspicions surrounding the defendants’ involvement in the attempted murder, as outlined in Article 175, paragraph 1, item 1 of the Criminal Procedure Code. During the initial hearings, evidence such as witness testimonies and identification records were presented to support the case against Y.G. and N.D..
In light of this recent development, the High Court has emphasized the importance of judicial independence. They reminded the public that judges must be protected from any forms of pressure, threats, or public targeting, as their impartiality is crucial for upholding the rule of law and ensuring fair trials.
The judicial system calls on all public and political figures, as well as media and citizens, to refrain from making statements or engaging in actions that could be perceived as attempts to influence judicial decisions. The preservation of judicial independence is a legally protected value that all institutions and individuals are obligated to respect and safeguard, as stated by the High Court of Podgorica.
