Regulator Faces £7 Million Shortfall Due to Rising Solicitor Misconduct Claims

Allegations of solicitor misconduct are overwhelming the Solicitors Regulation Authority (SRA) to the extent that officials may need to increase the practising certificate fee to manage the escalating costs associated with these complaints. Recent documents from a board meeting indicate that the SRA is contending with a projected shortfall of nearly £7 million, although this is a reduction from an earlier estimate of £8.2 million.

The SRA reported a significant rise in misconduct allegations, with approximately 1,300 complaints received on average each month between November 2022 and July 2023. This represents a 27 percent increase compared to the same period the previous year. This surge in complaints has led the regulator to reconsider its financial strategies, particularly when determining the practising fee for the period of 2026-27.

Financial Implications for Solicitors

Currently, the practising fee for individual solicitors stands at £397, which includes contributions towards the compensation fund that addresses cases of solicitor fraud. In light of the rising allegations, the SRA stated, “when setting the 2026-27 practising fee, we will need to consider the appropriate approach towards increasing reserves as necessary.”

The increase in complaints not only affects the financial stability of the watchdog but also impacts its operational efficiency. The SRA has indicated that response times to complaints have doubled due to the volume of allegations, which may further strain resources and delay resolutions for solicitors facing allegations.
