Canal Towpath Incident: Fintan Burke Faces Court for Public Decency Offences
A man has finally appeared in court after refusing to attend earlier proceedings due to concerns about his appearance. **Fintan Burke**, charged with outraging public decency, was brought before **Reading Crown Court** on **January 12, 2024**, after an incident on the towpath of the **Kennet and Avon Canal** in **Newbury**, where he was caught engaging in a sexual act in public view. The incident also involved a woman, **Ana Hartman**, who ended up in the canal during the altercation.
Previously, Burke had refused to leave his holding cells to appear in court, insisting he would only do so when he was properly groomed. This led to the adjournment of his sentencing hearing. Burke, who has a history of violent offences, was remanded back into custody until further notice.
On January 12, Burke appeared from custody, legally represented by **Beth Vaughan**. He confirmed his personal details, stating, “I’m of no fixed address at the moment.” The magistrate, **District Judge Sundeep Pankhania**, then announced that the case would be adjourned until after Burke’s scheduled appearance at the crown court. He is set to return for sentencing on **February 9, 2024**.
The court proceedings highlighted Burke’s ongoing legal challenges, as he faces additional charges stemming from the towpath incident. These include assaulting Hartman and damaging her mobile phone, valued at **£300**, on **July 15, 2023**. Judge Pankhania indicated that if Burke fails to attend his next court date, the case could proceed in his absence, although efforts are underway to facilitate a video link for his appearance.
Despite the granting of unconditional bail for the court proceedings, Burke remains in custody, pending sentencing for the public decency offence. A psychiatric assessment deemed him fit to plead, but after his refusal to appear unshaven, the judge ordered an updated report to ensure his fitness for trial. If the findings align with the initial evaluation, Burke will face sentencing for his public decency offence on **February 5, 2024**.
