Clarence Town Board Enacts New Law to Curb Reckless E-Bike Use

The Clarence Town Board has unanimously approved a new law aimed at addressing the reckless use of electric bicycles and gas-powered dirt bikes on the town’s bike paths and walking trails. This decision, made on August 23, 2023, comes in response to a troubling summer marked by numerous e-bike accidents, including the tragic death of 16-year-old Daniel Bechtel, who died after crashing an electric dirt bike.
The law empowers police to impound vehicles used illegally and establishes fines for reckless behavior. According to Clarence Supervisor Patrick Casilio, the legislation is intended to enhance safety for all trail users. “This law is geared towards people that are on our bike trails being reckless,” Casilio stated, emphasizing the need for authority to manage irresponsible riders.
As the popularity of e-bikes surges, with sales escalating from 250,000 in 2018 to over 1 million in 2022, lawmakers recognize the necessity for stricter regulations. The new law reflects a growing concern for public safety amid increasing incidents involving these vehicles. In New York, riders must be at least 16 years old, and operating e-bikes on sidewalks is prohibited.
Violations of the new law may result in fines of up to $250 or imprisonment for up to 15 days. If a vehicle is impounded, it will not be returned until proof of ownership is provided and all impound fees are paid. Town Attorney Lawrence Meckler clarified that the law does not ban the use of these vehicles; instead, it focuses on preventing reckless behavior.
During a public hearing preceding the law’s passage, community members voiced their support and concerns. Kathy Campagna from Harris Hill sought clarity to ensure her responsible use of her e-bike remains compliant with the new regulations. “I just came here to be sure that I am in compliance with the law,” she remarked.
Local resident Wendy Merkle recounted a troubling experience involving a group of young riders who obstructed traffic. “I beeped at them to move over, and one of them popped a wheelie and landed the front tire of their bike on my car,” she described, underscoring the need for such legislation.
The new law comes in the wake of several accidents involving e-bikes and other two-wheeled vehicles. Bechtel’s fatal accident occurred in a parking lot after he collided with a grassy median while riding without a helmet. In another incident in Niagara Falls, an e-bike operator was killed when he turned in front of a tow truck, having been riding against traffic.
Other communities are also taking steps to address reckless e-bike use. For instance, East Aurora is considering granting police the authority to issue citations to parents of irresponsible young riders. Chief Patrick Welch expressed the urgency to tackle the issue before a tragedy occurs.
As the meeting concluded, Supervisor Casilio honored Daniel Bechtel’s memory, stating, “I hope we save lives today. That’s our goal.” The new law represents a significant effort by the Clarence Town Board to ensure safer riding practices and protect the community as the prevalence of e-bikes continues to grow.
