Judges’ Association Warns Against Personal Attacks on Judiciary
The Judges’ Association of Montenegro has expressed concern regarding the content of a public statement published in the media, which includes qualifications and claims that exceed the boundaries of acceptable and legitimate criticism of judicial proceedings. The association emphasizes that while the right to publicly criticize judicial decisions is undeniable and protected, such criticism must focus on legal reasoning and the justification of rulings, rather than on the personal attributes of judges, their expertise, integrity, or alleged motives for making decisions.
The association specifically highlighted that assertions suggesting a judge “did not read the complaint” or “consciously fabricated reasons” for a ruling constitute unacceptable personal attacks. Such comments not only undermine the individual judge but also exert pressure on the judicial authority, jeopardizing public trust in the independence and impartiality of the judiciary.
Defending the Integrity of the Judiciary
According to the Judges’ Association, any potential errors in a judge’s work should be examined solely through legally prescribed mechanisms rather than through media disqualifications that imply dishonorable or illegal motivations. The statement underscores the obligation of judges to make decisions freely, independently, and without pressure. It also calls on all participants in the public discourse to contribute to maintaining the dignity of the judicial function and the rule of law.
