Florida Bar Investigates Lindsey Halligan, Former Trump Prosecutor
Former prosecutor Lindsey Halligan, known for her role in indicting political opponents of Donald Trump, is currently under investigation by the Florida Bar Association. The investigation stems from allegations that Halligan unlawfully claimed the title of US attorney and continued to sign court orders under that title despite a judge’s ruling deeming her appointment invalid.
The Florida Bar confirmed the investigation in a letter addressed to the nonprofit organization Campaign for Accountability, which filed complaints against Halligan. At just 36 years old, Halligan was appointed by Trump to serve as interim US attorney for the Eastern District of Virginia, despite lacking prior experience as a federal prosecutor.
Halligan previously worked as a White House aide and was involved in legal matters concerning high-profile figures such as former FBI Director James Comey and New York Attorney General Letitia James. However, both cases were dismissed after a federal judge found her appointment unlawful.
In a statement, Michelle Kuppersmith, executive director of Campaign for Accountability, emphasized the importance of accountability in the legal profession, stating, “We want to encourage state bars to continue doing their duty where they see fit.” The organization is seeking to stop Halligan from allegedly misusing her position and bar license for improper purposes.

Halligan’s troubles began when US District Judge David Novak barred her from presenting herself as the interim US attorney. In his ruling, Novak emphasized that Halligan had “no legal basis” to claim the title and warned of potential disciplinary action if she continued to do so. He described her conduct as a “charade” that needed to end immediately.
The Florida Bar Association’s letter indicated that it had been monitoring developments related to Halligan’s case. The ongoing investigation could lead to significant consequences, including potential disbarment, although such processes typically take years. Investigations are reviewed by a grievance committee composed of both lawyers and community volunteers, which assesses whether there is probable cause for violations of professional conduct.
The Department of Justice has also taken an interest in the case, recently posting a notice in the Federal Register to seek greater authority in reviewing state bar investigations. This development could allow the DOJ to examine complaints against its attorneys more closely.

The complaints filed against Halligan suggest a serious breach of her ethical obligations. As the investigation unfolds, Florida’s legal community is watching closely. Kuppersmith expressed hope that the Florida bar would conduct a thorough inquiry into Halligan’s actions, ensuring that all ethical standards are upheld.
Upon stepping down from her role in January, Halligan noted that judges had repeatedly viewed her appointment as disqualifying, stating, “The court’s remedy did not match its rhetoric.” Following her departure, the Department of Justice has been appealing the ruling that invalidated her appointment and subsequently dismissed the prosecutions against Comey and James.
As the situation develops, Halligan’s future in the legal profession remains uncertain, and the implications could resonate well beyond her individual case, raising questions about accountability and ethics in public service.
