Government Inspector Rejects Smethwick Food Trailer Proposal
A proposal to maintain a food trailer at a car park in Smethwick has been dismissed after a government inspector upheld the local council’s decision. The application sought temporary permission for a three-year period to park the food trailer at the Cedar Court car park, located off Brasshouse Lane. Sandwell Council had previously rejected this application, citing inadequate parking and safety concerns.
The council’s assessment highlighted significant issues regarding parking capacity. They stated that the car park, which has only ten designated spaces, would require at least 14 spaces to accommodate the proposed food trailer alongside existing vehicles. The council also noted that the trailer would obstruct pedestrian visibility, increasing the risk of accidents for both drivers and customers.
In their findings, Sandwell Council emphasized the proposal’s potential negative impact on local traffic and pedestrian safety. The rejection statement read: “The proposal and existing uses would require 14 off-street parking spaces, however only ten spaces are allocated. Furthermore, the proposed food trailer will also decrease pedestrian visibility.”
Inspector’s Agreement with Council Findings
The matter was subsequently appealed to a government planning inspector, who had the authority to overturn the local council’s ruling. However, the inspector concurred with Sandwell Council’s concerns regarding parking availability and safety. The inspector’s report highlighted that the presence of the food trailer would pose a “significant risk of harm to pedestrian safety,” particularly due to limited visibility for both exiting vehicles and waiting customers.
The inspector noted the challenges posed by nearby streets, many of which have sections marked with double-yellow lines. While some areas permit parking, it was observed that vehicles often encroach on the pavement to facilitate two-way traffic along Brasshouse Lane. This situation narrows the available width of the pavement, creating difficulties for pedestrians, including those with wheelchairs or strollers.
The inspector elaborated on the challenges that potential customers might face when attempting to visit the trailer. “Customers who would visit by car, especially in the evening when most residents of the surrounding area would be at home, would find it challenging to park nearby,” the inspector stated. The anticipated increase in demand for parking would likely result in inappropriate parking practices, further jeopardizing pedestrian safety.
