Trump Responds to Supreme Court Ruling with New 10% Global Tariff
President Donald Trump announced a new 10% global tariff on February 20, 2024, just hours after the US Supreme Court invalidated his previous trade duties. This unexpected move represents a significant escalation in his trade policy, as the Supreme Court’s ruling had dismantled a central aspect of his economic strategy.
The Supreme Court ruled in a 6-3 decision that Trump had overstepped his legal authority under the International Emergency Economic Powers Act. Chief Justice John Roberts authored the majority opinion, stating that the law does not permit the president to impose unlimited tariffs without congressional approval. The ruling not only stripped Trump of a critical negotiating tool but also raised immediate concerns regarding trade agreements with key partners, such as Canada, China, and the UK.
News of the Supreme Court’s decision reached Trump during a breakfast meeting with state governors. According to reports from CNN, the atmosphere shifted dramatically as Trump learned of the ruling. He expressed his anger by denouncing the judiciary and reportedly used profane language, declaring, “These effing courts.”
Despite this setback, Trump refused to retreat. He held a press briefing shortly thereafter to unveil retaliatory trade measures, indicating that his administration would leverage the Trade Act of 1974 to impose tariffs. “Today I will sign an order to impose a 10% global tariff under Section 122 over and above our normal tariffs already being charged,” Trump stated. This provision allows for tariffs of up to 15% for a period of 150 days to address balance-of-payments deficits.
In addition to the global tariff, Trump confirmed that existing national security tariffs under Section 232 and current Section 301 tariffs would remain in effect. “Effective immediately, all national security tariffs… remain in place, fully in place, and in full force and effect,” he emphasized.
The White House also indicated plans to investigate nations accused of market manipulation. Trump announced the initiation of several Section 301 investigations aimed at countering unfair trading practices, suggesting further economic penalties could result and potentially ignite new trade disputes.
As he concluded his remarks, Trump reiterated his commitment to his political messaging, stating, “Make America great again… we’ve already made it great so I don’t have to use that, but I don’t think we’ll ever give up on MAGA. MAGA is always going to be with us.”
The implications of Trump’s new tariff and the Supreme Court’s ruling are likely to reverberate throughout global markets, affecting international trade dynamics and relationships with key allies and adversaries alike.
